Privacy policy
Pursuant to article 13 of Regulation 679/2016/EU, we would like to inform you that the personal data that we acquire and which concern you will be processed in compliance with the requisites of the Regulation and your rights as “data subjects”, as recognised by the Regulation.
a) Processing will include the following operations: collection over the telephone or electronically or in writing or from public registers, lists, acts and documents and/or public and/or private databases (commercial information companies), registration, organisation, storage and processing on paper, by magnetic, automated or computerised means, processing of the collected data by third parties, modification, selection, extraction, comparison, use, interconnection with the data of other persons based on qualitative, quantitative and temporal criteria, recurrent or defined on a case-by-case basis, temporary processing for fast compilation or transformation of said data, adoption of automated and/or discretionary decisions, creation of profiles and briefing notes, communication, erasure and destruction of the data, or a combination of two or more of the aforementioned operations.
b) Subject to disclosure to third parties in fulfilment of legal obligations or obligations arising from EU regulations or other legislation, the data will be disclosed by us in Italy and abroad, within the European Union, to the following: 1) our sales network 2) other affiliated companies and/or subsidiaries (which will process the data for purposes related to those mentioned herein); 3) companies, bodies, associations and/or natural persons who provide us with ICT services and the related maintenance; 4) banks and credit institutions; 5) insurance companies; 6) factoring companies; 7) leasing companies; 8) credit collection and/or debt recovery companies; 9) insurance or debt recovery companies; 10) commercial information companies; 11) consultants and professionals; 12) professional and corporate consultancy offices; 13) auditors; 14) freight forwarders, carriers and couriers; 15) telecommunications operators; 16) public economic bodies; 17) customers/suppliers and sub-suppliers; 18) judicial authorities in case of criminal investigations; 19) other persons whose right to access the data that concern you is recognised by provisions of the law or secondary or EU legislation; 20) other companies, bodies and/or natural persons who perform activities connected, instrumental to and/or supporting our own, or necessary and/or useful for the performance of contracts or services requested by you. Said subjects will process and, in turn, communicate the data to third parties in their capacity as “data controllers” or “data processors” pursuant to the relevant provisions of Regulation 679/2016/EU.
c) The aforementioned processing and/or communication operations will have the following purposes: 1) the satisfaction of precontractual needs (e.g. instruction for offers or your orders, checks into solvency); 2) the fulfilment of legal and contractual obligations (e.g. purposes of accounting, taxation formalities, administrative management); 3) the fulfilment of legal obligations set forth in regulations on money laundering (e.g. the electronic/paper-based archive of Legislative Decree 231/07 as amended by Legislative Decree 151/09 and subsequent amendments and integrations); 4) customer management; 5) supplier management; 6) the management of credit; 7) risk control (fraud, insolvency, etc.); 8) the management of disputes and debt recovery; 9) the management of the cash flow and accounts; 10) financial services which are instrumental to the management of customers/suppliers; 11) the management of means of electronic payment; 12) insurance services instrumental to the management of customer/suppliers; 13) the management of warehouses and transports; 14) the management of commercial relationships; 15) operational and strategic marketing; 16) sales by mail order and e-commerce; 17) telemarketing and tele-selling; 18) commercial information, sending advertising material, direct sales or interactive commercial communication; 19) quality certification; 20) measuring the level of satisfaction of customers/suppliers.
d) The provision of data by you is mandatory only for the purposes under points 1 to 14 above and your consent to processing for such purposes is not necessary. Eventual refusal to provide data will, however, result in the impossibility to establish or develop contractual relationships with your Company.
e) The data will be processed and stored for the entire duration of the contractual relationship established with your Company and, thereafter, for the period of time that is necessary for the fulfilment on our part of our obligations arising from the law, to store your economic profile for the streamlining of the selection of customers and/or suppliers and, with your consent as per below, for the commercial purposes under points 15 to 20.
f) With regard to the data that are processed and to which this notice pertains, the data subject has at any time the right of:
• Access (article 15 of Regulation (EU) 2016/679);
• Rectification (article 16 of Regulation (EU) 2016/679);
• Erasure (article 17 of Regulation (EU) 2016/679);
• Restriction (article 18 of Regulation (EU) 2016/679);
• Portability, understood as the right to receive the data from the data controller in a structured, commonly used and machine-readable format and transmit those data to another controller without hindrance (article 20 of Regulation (EU) 2016/679);
• Object to processing (article 21 of Regulation (EU) 2016/679);
• Withdraw the consent to processing, without prejudice to the lawfulness of the processing based on the consent before its withdrawal (article 7 paragraph 3 of Regulation (EU) no. 2016/679);
• Lodge a complaint with the Personal Data Protection Authority (article 51 of Regulation (EU) no. 2016/679).
